DIRECTV Mobile/Marketing Alerts Text Messaging Terms and Conditions

By sending a text message for participation in Mobile/Marketing services, or by otherwise opting in to DIRECTV Mobile/Marketing alerts you are agreeing to these DIRECTV Mobile/Marketing Terms and Conditions and are agreeing to receive text messages sent through automated dialing equipment. These Terms and Conditions may change from time to time, and we will post any updates here.

Data and text message rates will apply to each text message sent or received in accordance to your wireless plan (contact your wireless carrier for pricing plan details). Supported US Carriers: AT&T, Sprint, Boost, Verizon Wireless, U.S. Cellular, T-Mobile, Cincinnati, Alltel, Virgin Mobile USA, Cellular South, Unicel, Centennial, and Ntelos. DIRECTV Mobile/Marketing is open to existing residential DIRECTV customers 18 years of age or older with accounts in "good standing" in DIRECTV's sole discretion. Customers will receive up to 5 marketing text messages per month from 223322 with special offers and programming updates. Customers can opt-out at any time from receiving text messages by texting "STOP", "END", "QUIT", "CANCEL", "UNSUBSCRIBE" to "223322". VOID wherever prohibited by law.

1. Cost of Participation

DIRECTV Mobile/Marketing services require no purchase or fee for participation. Carrier message and data rates may apply to each message sent and/or received.

2. Confirmation and Opt Out

You understand and agree that you will receive a confirmation text message for each text message, vote, quiz response or similar text message sent to the DIRECTV Mobile/Marketing short code. Such confirmations may offer you the opportunity to opt-in to other DIRECTV Mobile/Marketing services. You will not, however, be opted in to other DIRECTV Mobile/Marketing services without your permission. You may opt out of receiving DIRECTV Mobile/Marketing Text messages by replying "STOP", "END", "QUIT", "CANCEL" or "UNSUBSCRIBE". If you experience any problems with opting out of DIRECTV Mobile/Marketing Text Messaging or if you need help or additional information related to DIRECTV Mobile/Marketing Alerts Text Messages, please text "HELP" to short code 223322. If you opt out of DIRECTV Mobile/Marketing Text Messaging, you are only opting out of receiving mobile alerts associated with short code 223322. If you participate in other DIRECTV text messaging services, including the DIRECTV Mobile Account Management Text Messaging service from 21880, you will continue to receive those alerts (unless and until you reply "STOP" to the short code associated with the separate text messaging service). You will also continue to receive telephone calls to wireless telephone numbers provided by you as contact information on your account.

3. User Conduct

You agree not to send or otherwise make available content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, or contains hate speech. You acknowledge that DIRECTV may or may not pre-screen text message content you provide, but shall have the right, without obligation and in its sole discretion, to pre-screen, refuse, or remove any content you make available, including content that violates this section. By opting in to any text messaging service from a cellular telephone number, you are representing to DIRECTV that the cellular telephone line from which you have opted-in is one for which you can provide consent to receive text messages from DIRECTV. You agree that if and before you disconnect that phone line, you will send a STOP ALL message to each DIRECTV short code you have opted in to in order to stop future text messages from being sent to that number.

4. Rights

By sending text messages for use on a campaign, you grant DIRECTV the perpetual, irrevocable, and fully sublicensable license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform, and publicly display any and all text message content provided by you to DIRECTV (in whole or in part) and to incorporate such content into other works in any format now known or later developed.

6. No Guarantee

DIRECTV is not responsible for incomplete, lost, late, or misdirected messages, including (but not limited to) undelivered messages resulting from any form of filtering by your mobile carrier or service provider, and cannot guarantee that all messages received by DIRECTV for messaging campaigns will be broadcast by DIRECTV.

7. United States Only

DIRECTV Mobile/Marketing alerts are currently available only to residents of the United States. You understand and acknowledge that you may not sign up for, access, or attempt to access or use the DIRECTV Mobile/Marketing Services from countries outside of the United States.

8. DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR PARTICIPATION IN DIRECTV'S MOBILE/MARKETING CAMPAIGN, IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. DIRECTV AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, EMPLOYEES, PARTNERS, AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. DIRECTV, ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, EMPLOYEES, PARTNERS, AND LICENSORS MAKE NO WARRANTY THAT (A) THE SERVICES WILL MEET YOUR REQUIREMENTS; (B) THE SERVICES WILL BE UNINTERRRUPTED, TIMELY, SECURE, OR ERROR-FREE; OR (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE.

9. LIMITATION ON LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT DIRECTV, ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, EMPLOYEES, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, EVEN IF DIRECTV HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICES, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICES, OR ANY OTHER MATTER RELATING TO THE SERVICES. SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

10. Indemnification

You agree to indemnify and hold harmless DIRECTV, its subsidiaries, affiliates, officers, agents, employees, partners, and licensors, from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of DIRECTV Mobile/Marketing alerts (such as text message content you submit, post, transmit, or otherwise send to DIRECTV), including (but not limited to) claims that your content is tortious, defamatory, invasive of privacy, or violates the intellectual property rights of another.

11. Termination

DIRECTV reserves the right, in its sole discretion, to cancel or suspend the DIRECTV Mobile/Marketing Text Messaging service, in whole or in part, for any reason, with or without notice to you.

12. Applicable Law and Disputes

These Terms and Conditions and our relationship with you regarding DIRECTV Mobile/Marketing Alerts are governed by the DIRECTV Customer Agreement and expressly include Section 9, Resolving Disputes, which requires individual arbitration of disputes that cannot be informally resolved, or an individual action in small claims court in lieu of arbitration.

13. Other

If any part of these Terms and Conditions is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of these Terms and Conditions, and the remaining portions shall remain in full force and effect.
