AT&T Mobility LLC (“AT&T”, “we,” “us,” or “our”), licenses the AT&T Secure Family and AT&T Secure Family Companion applications and related services (“App” or “Apps” as defined below) to the primary account owner (“Account Owner”) conditioned upon acceptance of and compliance with this End User License Agreement (“Agreement” or “License”). By clicking "I Agree" or "Accept," creating an account, downloading, installing, accessing, or using the App or Service, each User agrees to the terms that apply to that User's role, including as Account Owner, Admin, Parent Admin, Viewer, Family Member, or Minor User, as applicable. The Account Owner, each Admin, each Parent Admin, and each Viewer must be 18 years of age or older.

  • The Account Owner may invite adult Family Members and Minor Users to use the App and may authorize adult Family Members to act as Admins or Viewers, subject to available Service settings and permissions.

For each Minor User, the Account Owner must designate a Parent Admin who is a Parent with legal authority to act for the Minor User. The Parent Admin must accept this Agreement on behalf of the Minor User.

The App and Service may collect, use, and disclose Device location, Device activity, driving-related data, and other personal information of Users, Family Members, and Minor Users as described in this Agreement and the AT&T Privacy Notice, including disclosure to AT&T’s trusted service providers, affiliates, and other third parties as necessary to provide, maintain, support, and improve the App and Service.

The Account Owner, each Admin, and each Parent Admin is responsible for providing true and accurate information about themselves and the Family Members or Minor Users they set up, invite, manage, monitor, or authorize through the App, and for providing any required notices to those Family Members or Minor Users.

The Account Owner, each Admin, and each Parent Admin, as applicable, is authorized to provide information about the Family Members and Minor Users they set up, invite, manage, monitor, or authorize through the App, to monitor or manage their App and Service use, and to accept this Agreement on their behalf only where permitted by law, this Agreement, and the applicable role permissions. Only the Parent Admin may accept thisAgreement on behalf of a Minor User or authorize another permitted User to monitor, view, or manage information about that Minor User.

Each User agrees to abide by the AT&T Acceptable Use Policy, available at https://www.att.com/legal/terms.aup.html.

Each User agrees to the terms of the AT&T Privacy Notice, https://about.att.com/csr/home/privacy.html.

Each User agrees to the terms of the most current AT&T Consumer Service Agreement, available at https://www.att.com/legal/terms.consumerServiceAgreement.html (“CSA”). The CSA requires arbitration on an individual basis to resolve disputes rather than jury trials or class actions. If there is a conflict between this Agreement and the CSA, the applicable provision of the CSA controls.

The AT&T Acceptable Use Policy, AT&T Privacy Notice, and CSA are incorporated into and are part of this Agreement.

If at any time after reviewing or using the App Account Owner wishes to terminate such use or this License, Account Owner, Admin, or Family Member must un-install and remove the App from their Device and delete any copy in their possession. This License will automatically terminate if Account Owner is no longer an AT&T subscriber subject to the terms of the CSA.

1. DEFINICIONES:

  1. "Account Owner" means the primary account holder who activates the Service and has primary responsibility for the account. "You" and "Your" mean the Account Owner, except where this Agreement expressly states that an obligation applies to another User or to all Users.
  2. “Admin” means an adult Family Member authorized by the Account Owner and, where applicable, by the Parent Admin to administer some or all features of the Service for one or more Family Member or Minor User profiles.
  3. “AT&T,” “We,” “Our” and “Us” mean AT&T Mobility LLC and its parents, subsidiaries, affiliates, agents, employees, successors and assigns.
  4. "App" or "Apps" means the AT&T Secure Family application and the AT&T Secure Family Companion application, any website, software, content or services provided in connection with the App, and any updates to these items. App use may result in increased battery usage by a Device with the App. Voice, data and messaging rates may apply when a User uses this App.
  5. “Device(s)” generally means a mobile smartphone or tablet that performs many of the functions of a computer, typically having a touchscreen interface, internet access, and an operating system capable of running downloaded application.
  6. “Family Members,” means individuals set up in the App, other than the Account Owner. A Family Member may be an adult or a Minor User, but role-specific permissions may differ.
  7. “Minor User” means an individual under the age of majority in their jurisdiction who uses the App under the management of a Parent Admin.
  8. “Parent” means a parent or legal guardian with legal authority over a Minor User.
  9. “Service” means the AT&T Secure Family Service provided via the Apps including but not limited to its features as described herein.
  10. User means any individual who downloads, installs, accesses, or uses the App or Service, including the Account Owner, an Admin, a Viewer, a Family Member, and a Minor User, as applicable.
  11. "Viewer" means an adult Family Member authorized by the Account Owner and, where applicable, by the Parent Admin to view certain User information and use only those features made available to a viewer profile. A Viewer may not manage settings, permissions, restrictions, or controls unless separately authorized as an Admin.

2. EL SERVICIO AT&T SECURE FAMILY:

The Service allows the Account Owner and any authorized User, including an Admin, Parent Admin , or Viewer, to track and monitor the location, device activity, online activity, and other available Service-related information of Family Members and Minor Users, as permitted by the applicable profile type, Service settings, Device permissions, and authorizations.

2.1 Configuración de tu servicio Secure Family en la aplicación

  • The Account Owner must install the Secure Family App on their Device, activate the Service, and create a profile for each Family Member they wish to monitor.
  • The Account Owner is the primary administrator for the account and may authorize one or more adult Family Members as Admins or Viewers for Family Member profiles.
    • Account Owner can set content filters on each Device to customize Family Member’s access to age-appropriate websites and apps; there are three filters High, Medium, Low or No filter.
    • Account Owner may authorize Family Members to track their Device’s location.
  • The Account Owner may block Minor/Family Member access to Apple App or Google Play Stores.
    • Account Owner can prevent a Minor/Family Member from visiting either store by using the App’s Content Filters/Block feature to block the App Stores & Downloads category which prevents a Minor/Family Member’s Device from accessing the Apple App Store or Google Play Store.
  • The Account Owner must designate a Parent Admin for any Minor User invited to use the App. Only the Parent Admin can authorize the Account Owner or any other Admin or Viewer to track, view, or monitor the Minor User’s activity.
  • The Parent Admin for any Minor User must install the Secure Family Companion App on the Minor User's Device(s) and must pair the Minor User's Device(s) with their Device. To set up the Secure Family Companion App, Parent Admin, you must do the following:
  • select “Add family member” or “Invite Family” and select the “Child or Teen” profile type from the Secure Family App installed on your device;
  • send an invite code by text message or email to Minor User’s Device, accept the invitation, download the Secure Family Companion App from the Apple App Store or Google Play Store on the Minor User’s Device, and enter the invite code; or alternately scan a QR code displayed on the Secure Family App on your Device using the Secure Family Companion App downloaded on Minor User’s Device(s) from the Apple App Store or Google Play Store, as applicable;
  • from the Secure Family Companion App on Minor User’s Device, review and accept the applicable terms and conditions for the Minor User;
    • install the Secure Family VPN;
    • enable any required settings, device permissions, restrictions, or controls used to support the Service;
    • enable features, location sharing and notification permissions;
    • and, for iOS Devices, set up Apple Family Sharing and any required Apple child account or profile information through Apple's operating system-level process. This may require you to provide your Apple ID and the Minor User's name and birthdate to Apple.
  • The Parent Admin is fully responsible for managing applicable settings, permissions, restrictions, and features for their Minor User, and providing any required notices to the Minor User.
  • The Parent Admin may invite the Account Owner and adult Family Members to monitor and track a Minor User's activity in the App by sending them an invite code by text message, or scanning a QR code on their Device. Once the Account Owner, other Admin and/or Family Member(s) accept the invitation, the Parent Admin must pair its Device to their Device(s), enabling them to view the Minor User's location and App activity.

2.2 Descripciones de las funcionalidades

For Minor Users, the Parent Admin must enable and manage the applicable features, settings, permissions, and controls, unless the Parent Admin authorizes the Account Owner or another Admin to do so.

The Account Owner and any Admin authorized by Account Owner or, for Minor Users, by the Parent Admin can track a Family Member's or Minor User’s Device location on an interactive map using one of two options: Device-based GPS service or Network Location.

Device-based GPS Location: If the Secure Family Companion App is activated on a Family Member Device(s), the Account Owner or authorized Admin can track their Device(s) with GPS location tracking.

Network Location: This feature is only supported for Account Owners who are post-paid AT&T wireless subscriber that subscribed to the Service before July 31, 2023. Users on these legacy accounts can upgrade their Secure Family App to the current version. With Network Location tracking, the approximate location of the tracked Device is provided via cell towers and is less accurate than Device-based GPS Location. While the legacy Secure Family Companion App is not required to be installed on the tracked Family Member's Device to provide Network Location, the legacy Secure Family App features are limited to location on a map, location schedule alerts, location history, and saved areas.

2.2.2 Alertas de llegada/partida.

Account Owner and authorized Admin(s) can receive an alert on their Device when their Family Member’s Device enters or leaves a saved area (also known as a geofence).

Account Owner and authorized Admin(s) can view the location history of their Family Member’s Device for the past seven days.

2.2.4 Push Notifications

When a User is logged into the App, the User may receive a message asking if the User would like to allow push notifications. Push notifications are a way for the App to deliver information, including alerts, sounds and icon badges to the User's mobile Device. Push notifications can be delivered even when the User is not logged in or using the App. The App does not charge a fee for sending push notifications. Users may adjust push notifications at any time through the notification settings on their Device.

2.2.5 Mapa de ruta

Account Owner and authorized Admin(s) can view the location history of their Family Member’s Device on a map for the past 24 hours.

Parent Admin can set sleep and awake times on a Minor User's Device(s) to block internet access. The Parent Admin can authorize the Account Owner or another Admin to manage this feature.

The Parent Admin can set filters on internet and application content on their Minor User's Device(s) to limit access to appropriate websites and apps. There are three filters: High, Medium, Low or No filter. The default is High. The Parent Admin can authorize the Account Owner or another Admin to set manage this feature.

2.2.13 Minor User App/Web Time Usage

The Parent Admin can gain insight into how much time their Minor User spends online. The Parent Admin can authorize the Account Owner or another Admin to receive these insights.

2.2.14 Minor User Rewards

The Parent Admin can give a Minor User extra screen time as a reward through available Service settings. The Parent Admin can authorize the Account Owner or another Admin to manage this feature.

All Users can access AT&T Secure Family's Digital Wellness site from within the App. This Guide is a centralized online resource to aid parents in supporting their child's online safety and wellbeing. 2.2.30 Driving Insights & Collision Detection

Driving Insights uses device location, motion, and sensor data to generate trip summaries, driving-related activity reports, scores, rankings, and notifications associated with a Family Member's device. Collision Detection uses device data to identify events that may indicate a vehicle collision and may generate alerts to authorized users.

These features depend on device compatibility, permissions, connectivity, operating system settings, and available device data. Driving activity, passenger status, trip summaries, scores, rankings, notifications, and collision alerts may be inaccurate, delayed, incomplete, or unavailable. Collision Detection may not identify all collisions and may generate false alerts. These features are provided for informational purposes only and are not emergency, safety, or emergency-response services.

For Minor Users, the Parent Admin controls whether this feature is enabled, unless the Parent Admin authorizes the Account Owner or another Admin to manage it.

2.3 CONSENTIMIENTO PARA DIVULGAR INFORMACIÓN DE UBICACIÓN:

The App accesses and uses location information, including Device-based GPS and, for eligible legacy users, Network Location information ("Location Information"), to provide location tracking and related Service features. The Account Owner may set up, manage, and turn off location tracking for Users and Family Members through the App and applicable Device settings, and may authorize an Admin to do so, subject to the Admin's assigned profile type, permissions, and Service settings. For Minor Users, only the Parent Admin may set up, manage, or turn off location tracking, unless the Parent Admin authorizes the Account Owner or another Admin to do so. By using the App, each User agrees that AT&T and its trusted service providers may collect, use, aggregate, and disclose Location Information as necessary to provide, maintain, support, and improve the App and Service and as otherwise described in this Agreement and the AT&T Privacy Notice.

To stop allowing Location Information to be tracked or shared through the App, the Account Owner, authorized Admin, or Parent Admin, as applicable, must turn off location tracking or location sharing in the App, or disable applicable Device tracking services, including location permissions, through the Device’s operating system settings.

The Account Owner may choose not to share the Account Owner's location with Family Members and may turn off location sharing for adult Family Members, subject to applicable Service settings and permissions. An authorized Admin may also manage location sharing if permitted by the Account Owner. To turn off location sharing for a profile, Account Owner/Admin must select the applicable profile on the Family Hub, select "Edit Profile," and toggle Off "Share location with all family members." This will stop sharing the location of all Devices under that profile.

The Account Owner/authorized Admin may also manually delete the Family location history within the Secure Family App by going to App Settings > Privacy and selecting “Delete location data.”

2.4 CONSENTIMIENTO PARA DIVULGAR INFORMACIÓN PERSONAL:

Personal information collected through the App may include information that a User, Account Owner, or Admin enters or provides through the App, as well as information the App collects or generates when Users, Family Members, or Minor Users use the App or Service. AT&T may use and disclose this information, including to AT&T's trusted service providers and other third parties, as necessary to provide, maintain, support, and improve the App and Service and as otherwise described in this Agreement and the AT&T Privacy Notice.

If a Parent Admin allows a Minor User to use the App or Service, the Parent Admin represents that they have the legal authority to act on behalf of the Minor User and agrees that AT&T may collect, use, and disclose the Minor User’s personal information, including to AT&T’s trusted service providers and other third parties, as necessary to provide, maintain, support, and improve the App and Service and as otherwise described in this Agreement and the AT&T Privacy Notice.

2.6 SUSCRIPCIONES MENSUALES Y CANCELACIONES DEL SERVICIO

We may offer the App and related Service free for the first 30 days after which the Service automatically renews at $12.00/month unless the Account Owner cancels before the end of the first or a subsequent 30-day period. Before Account Owner cancels, Account Owner, Parent Admin, or authorized Admin must remove the App from applicable Family Member or Minor User Device(s), as applicable. Otherwise, the Account Owner may be unable to remove or manage the App from those Device(s) after cancellation.

2.7 FALTA DE PAGO.

If Account Owner fails to timely pay any fees or if we are unable to process the Account Owner's payment, AT&T, at its option and in its sole discretion, may suspend or terminate Account Owner's use of the App and the Service. Regardless of such termination or suspension, Account Owner will be responsible for paying all past due amounts. Termination or suspension of Account Owner's use of the App and Service will terminate or suspend all other Users of the App and Service.

3. CONCESIÓN DE LICENCIA Y RESTRICCIONES DE USO.

3.1 Concesión de licencia.

3.2 Restricciones de uso.

Tú y/o las personas de tu familia no deberán:

  1. a) violar esta licencia, incluida, entre otras, la Sección 4 relacionada con la propiedad intelectual de AT&T;
  2. b) violar las leyes, normas o regulaciones aplicables en relación con el acceso o uso de la aplicación por parte tuya o de tu familia;
  3. c) decompilar, aplicar ingeniería inversa, desarmar, intentar derivar el código fuente o descifrar la aplicación, cualquiera sea el propósito;
  4. d) modificar, adaptar, mejorar o crear cualquier trabajo derivado de la aplicación;
  5. e) eliminar, alterar u ocultar cualquier aviso de propiedad (incluido cualquier aviso de derechos de autor o marca comercial) de AT&T o sus colaboradores, proveedores o licenciantes;
  6. f) utilizar la aplicación de manera que se deriven ingresos directamente de dicho uso, o usar la aplicación para cualquier otro fin para el que no esté diseñada o destinada;
  7. g) utilizar la aplicación de manera contraria a su uso previsto; o
  8. h) eludir, deshabilitar o alterar cualquier componente relacionado con la seguridad u otras salvaguardias o medidas de protección aplicables a la aplicación o al dispositivo.

You, Admin, and Your Family Members agree to abide by the rules and policies established from time to time by AT&T. Such rules and policies may include, for example, required or automated updates, modifications, and/or reinstallations of the App and obtaining available patches to address security, interoperability, or performance issues. 4. DERECHOS DE PROPIEDAD INTELECTUAL.

AT&T y sus colaboradores, licenciantes y proveedores se reservan el derecho de cambiar, suspender, cancelar, eliminar, imponer límites sobre el uso o el acceso, deshabilitar el acceso o requerir la devolución de la aplicación (o cualquier copia de esta) en cualquier momento sin previo aviso y no tendrán ninguna responsabilidad por hacerlo. 4.2 Marcas de AT&T.

Los siguientes nombres de compañías y sus logotipos relacionados y todos los nombres de productos y servicios, marcas de diseño y lemas relacionados son marcas comerciales y marcas de servicio propiedad de y utilizadas bajo la licencia de AT&T: "AT&T", "AT&T Secure Family" (las "Marcas de AT&T"). Tú y las personas de tu familia no están autorizados a usar las Marcas de AT&T en ningún tipo de anuncio, publicidad o de cualquier otra manera comercial sin el consentimiento previo por escrito de AT&T, que puede no conceder con motivo o sin motivo. Estas obligaciones siguen estando vigentes aunque se cancele esta Licencia.

4.3 Software de código abierto.

La Aplicación puede incluir software de terceros que está sujeto a los términos de una licencia de código abierto ("Software de código abierto"). Tú y las personas de tu familia reconocen y aceptan que el derecho de usar dicho software de código abierto como parte de la aplicación está sujeto a y regido por los términos y condiciones de una licencia de código abierto aplicable ("Términos de la licencia de código abierto"). En caso de que surgiera un conflicto entre los términos de esta Licencia y los Términos de la licencia de código abierto, prevalecerán estos últimos.

5. CONTENIDO DE TERCEROS.

La aplicación puede permitir el acceso a productos, servicios, sitios web, anuncios y contenido de anunciantes, editores, proveedores y otros terceros ("Contenido y servicios de terceros"). El uso que tú y tu familia hagan del contenido y los servicios de terceros CORRE POR CUENTA Y RIESGO DE TI Y TU FAMILIA, y puede estar sujeto a términos de uso adicionales establecidos por terceros. AT&T no investiga, monitorea, representa, avala ni publica contenido y servicios de terceros. AT&T se reserva el derecho de restringir o negar el acceso a cualquier contenido y servicio de terceros al que se acceda a través de la aplicación. AT&T no tendrá responsabilidad alguna ante ti o tu familia que pudiera surgir de o estar relacionada con el acceso y uso (o uso indebido) del contenido y los servicios de terceros.

6. CONTENIDO ENVIADO POR EL USUARIO.

La aplicación puede contener funcionalidades que les permiten a ti y a tu familia enviar, publicar o mostrar contenido a través de la aplicación. Tú y las personas de tu familia acuerdan no usar ni permitir que otros usen la aplicación, directa o indirectamente de una manera que viole la Norma de uso aceptable de AT&T. El Cliente es el único responsable de toda responsabilidad que surja del contenido enviado por el usuario.

Si tú o las personas de tu familia proporcionan contenido a través de la aplicación ("Material enviado por el usuario"), le conceden a AT&T un derecho y licencia libre de regalías, perpetuo, irrevocable, no exclusivo y totalmente sublicenciable y transferible para usar, reproducir, modificar, adaptar, publicar, traducir, crear trabajos derivados de, distribuir, ejecutar y mostrar el material enviado por el usuario (en su totalidad o en parte) en todo el mundo y/o incorporarlo a otros trabajos en cualquier formato, medio o tecnología ahora conocidos o desarrollados en un futuro y para ejercer los mismos derechos con respecto a tales trabajos sin compensación o atribución alguna para ti o tu familia. AT&T no tiene obligación alguna de confidencialidad, expresa o implícita, con respecto al material enviado por el usuario. Declaras y garantizas que tú o tu familia poseen o, de lo contrario, controlan todos los derechos, acuerdos y permisos del material enviado por el usuario necesarios para enviar dicho material y para conceder a AT&T todos los derechos de licencia otorgados en el presente.

7. PLAZO Y CANCELACIÓN.

Esta Licencia será válida hasta que sea cancelada. AT&T podrá, a su entera discreción, en cualquier momento y por cualquier motivo o sin motivo alguno, desactivar la aplicación, o suspender o cancelar esta licencia y los derechos otorgados en virtud del presente, con o sin previo aviso u otra acción por parte de AT&T. Tras la cancelación de esta licencia, deberás cesar todo uso de la aplicación y desinstalarla. RECONOCES Y ACEPTAS QUE LA APLICACIÓN O EL SERVICIO, INCLUIDO TODO EL CONTENIDO DE ESTOS O AL QUE SE ACCEDE A TRAVÉS DE ESTOS, SE PROPORCIONAN "TAL COMO ESTÁN" Y "SEGÚN ESTÉN DISPONIBLES", Y QUE EL USO QUE HAGAS O LA MEDIDA EN QUE CONFÍES EN LA APLICACIÓN O EL SERVICIO CORREN POR TU CUENTA Y RIESGO. EN LA MEDIDA NO PROHIBIDA POR LA LEY, AT&T Y SUS COLABORADORES, PROVEEDORES Y LICENCIANTES POR LA PRESENTE RECHAZAN TODAS Y CADA UNA DE LAS DECLARACIONES Y GARANTÍAS RELACIONADAS CON LA APLICACIÓN Y LOS SERVICIOS, YA SEAN ORALES, EXPLÍCITAS, IMPLÍCITAS O REGLAMENTARIAS, Y YA SEA QUE SURJAN DE UNA LEY, ESTATUTO, USO COMERCIAL, COSTUMBRE, TRATOS COMERCIALES O DESEMPEÑO DE LAS PARTES, O DE LA NATURALEZA O CONTEXTO DE ESTA LICENCIA, INCLUIDAS, ENTRE ELLAS, LAS GARANTÍAS IMPLÍCITAS DE COMERCIABILIDAD, APTITUD PARA UN FIN EN PARTICULAR Y NO VIOLACIÓN. FURTHERMORE, AT&T AND ITS COLLABORATORS, SUPPLIERS AND LICENSORS MAKE NO WARRANTY THAT:

  1. I. LA APLICACIÓN Y LOS SERVICIOS CUMPLIRÁN CON TUS REQUISITOS;
  2. II. LA APLICACIÓN Y LOS SERVICIOS SERÁN ININTERRUMPIDOS, PRECISOS, CONFIABLES, OPORTUNOS, SEGUROS, LIBRES DE VIRUS U OTROS COMPONENTES DAÑINOS O LIBRES DE ERRORES;
  3. III. LA CALIDAD DE CUALQUIER PRODUCTO, SERVICIO, INFORMACIÓN U OTRO MATERIAL AL QUE ACCEDAS O QUE OBTENGAS A TRAVÉS DE LA APLICACIÓN O LOS SERVICIOS SERÁ TAL CUAL FUE DECLARADA O SATISFARÁ TUS EXPECTATIVAS;
  4. IV. CUALQUIER ERROR EN LA APLICACIÓN O LOS SERVICIOS SE CORREGIRÁ; O QUE SE REALIZARÁ MANTENIMIENTO DE LA APLICACIÓN O LOS SERVICIOS.

RECONOCES QUE LA APLICACIÓN O LOS SERVICIOS NO DEBEN SER UTILIZADOS NI SON APROPIADOS PARA SER UTILIZADOS EN SITUACIONES O ENTORNOS DONDE EL DESEMPEÑO, EL USO O USO INDEBIDO, LA FALLA, O LOS ERRORES O LAS IMPRECISIONES EN EL CONTENIDO, LOS DATOS O LA INFORMACIÓN SUMINISTRADOS POR LA APLICACIÓN O LOS SERVICIOS PODRÍAN RESULTAR EN UNA MUERTE, LESIÓN PERSONAL O DAÑO FÍSICO, DE LA PROPIEDAD O AMBIENTAL SERIO.

AT&T Y SUS COLABORADORES, PROVEEDORES Y LICENCIANTES NO GARANTIZAN QUE LA APLICACIÓN O LOS SERVICIOS SERÁN COMPATIBLES O INTEROPERATIVOS CON TU DISPOSITIVO O CUALQUIER OTRO COMPONENTE DE HARDWARE, SOFTWARE, EQUIPO O DISPOSITIVO INSTALADO O UTILIZADO EN CONEXIÓN CON TU DISPOSITIVO.

ADEMÁS, EL CLIENTE RECONOCE QUE LOS PROBLEMAS DE COMPATIBILIDAD E INTEROPERABILIDAD PUEDEN AFECTAR EL DESEMPEÑO DE SU DISPOSITIVO O HACER QUE FALLE POR COMPLETO, Y PUEDEN RESULTAR EN DAÑO PERMANENTE A SU DISPOSITIVO, PÉRDIDA DE DATOS UBICADOS EN SU DISPOSITIVO Y CORRUPCIÓN DEL SOFTWARE Y LOS ARCHIVOS UBICADOS EN SU DISPOSITIVO. EL CLIENTE ACEPTA Y RECONOCE QUE AT&T Y SUS COLABORADORES, PROVEEDORES Y LICENCIANTES, ASÍ COMO SUS AUTORIDADES, DIRECTORES, EMPLEADOS Y AGENTES, NO SERÁN RESPONSABLES ANTE EL CLIENTE POR NINGUNA PÉRDIDA QUE SEA CONSECUENCIA O SURJA EN RELACIÓN CON PROBLEMAS DE COMPATIBILIDAD O INTEROPERABILIDAD. EN CASO DE QUE SE COMPRUEBE QUE LA APLICACIÓN O LOS SERVICIOS SON DEFECTUOSOS, ASUMES LA RESPONSABILIDAD TOTAL POR TODO GASTO, SERVICIO, REPARACIÓN O CORRECCIÓN NECESARIOS. ESTA SECCIÓN 8 SEGUIRÁ ESTANDO VIGENTE AUNQUE SE CANCELE ESTA LICENCIA.

NO OBSTANTE LO MENCIONADO ANTERIORMENTE Y SIN RENUNCIAR A ELLO, LOS TÉRMINOS Y CONDICIONES DEL CSA PUEDEN OFRECERLE SOLUCIONES LEGALES LIMITADAS.

9. LIMITACIÓN DE RESPONSABILIDAD.

SALVO EN LA MEDIDA EN QUE ESTÉ PROHIBIDO POR LA LEY, EN NINGÚN CASO AT&T, SUS COLABORADORES, PROVEEDORES O LICENCIANTES, COMO ASÍ TAMPOCO SUS AUTORIDADES, DIRECTORES, EMPLEADOS Y AGENTES, SERÁN RESPONSABLES POR ACCIDENTES, DAÑOS A LA PROPIEDAD, LESIONES PERSONALES O MUERTE, NI POR DAÑOS INDIRECTOS, FORTUITOS, EMERGENTES, PUNITIVOS, ESPECIALES O EJEMPLARES QUE SE DERIVEN O RELACIONEN CON LA VENTA O LA DISTRIBUCIÓN, EL FUNCIONAMIENTO O LA FALTA DE FUNCIONAMIENTO, O EL ACCESO O EL USO, O LA IMPOSIBILIDAD DE ACCEDER O USAR LA APLICACIÓN O LOS SERVICIOS, INDEPENDIENTEMENTE DE QUE LOS DAÑOS FUERAN PREVISIBLES O DE QUE LAS PARTES HUBIERAN SIDO ADVERTIDAS DE LA POSIBILIDAD DE DICHOS DAÑOS. SIN LIMITAR LA GENERALIDAD DE LO MENCIONADO ANTERIORMENTE, LA RESPONSABILIDAD TOTAL DE AT&T HACIA TI (YA SEA EN VIRTUD DE UN CONTRACTO, ACUERDO EXTRACONTRACTUAL, DISPUESTO POR LEY O DE OTRO MODO) NO EXCEDERÁ EN NINGÚN CASO:

  1. (i) EL PRECIO DE COMPRA INICIAL QUE HUBIERAS PAGADO POR LA APLICACIÓN O LOS SERVICIOS,
  2. (ii) THE AGGREGATE AMOUNT YOU PAID TO AT&T FOR THE APP/SERVICES DURING THE ONE MONTH PRECEDING THE DATE THAT THE CLAIM ARISES, OR
  3. (iii) DOS DÓLARES ($2.00).

ESTAS LIMITACIONES SE APLICARÁN INCLUSO SI EL RECURSO ANTES MENCIONADO NO CUMPLIERA CON SU PROPÓSITO ESENCIAL. ESTA SECCIÓN 9 SEGUIRÁ ESTANDO VIGENTE AUNQUE SE CANCELE ESTA LICENCIA.

10. INDEMNIZACIÓN.

Tú y las personas de tu familia deberán indemnizar, defender y eximir de toda responsabilidad a AT&T y a sus colaboradores, proveedores y licenciantes, así como a sus autoridades, directores, agentes y empleados (las "Partes indemnizadas"), respecto de toda reclamación, proceso judicial, pérdida, daño, multa, penalización, interés y gastos (incluidos, entre otros, los honorarios de abogados y otros asesores profesionales) que surjan de o se relacionen con lo siguiente: (i) el acceso o el uso de la aplicación o los servicios o del contenido y los servicios de terceros por parte de ti o de tu familia, (ii) el incumplimiento por parte de ti o de tu familia de los términos de esta licencia, (iii) la violación de la ley por parte de ti o de tu familia, (iv) la negligencia o mala conducta por parte de ti o de tu familia, o (v) la violación por parte de ti o de tu familia de los derechos de un tercero. Deberás notificar por escrito a AT&T a la brevedad en caso de un reclamo de tercero que surja de o se relacione con el acceso o uso de la aplicación por parte de ti o de tu familia. Estas obligaciones siguen estando vigentes aunque se cancele esta licencia.

11. DISPOSICIONES VARIAS.

Las siguientes disposiciones siguen estando vigentes aunque se cancele esta Licencia:

11.1 Ley vigente, caducidad de las acciones.

Se considerará que esta licencia tiene lugar en el estado de Texas y se regirá e interpretará de conformidad con las leyes del estado de New York, salvo aquellas normas que versen sobre conflicto de leyes. Esta Licencia no se regirá por la Convención de las Naciones Unidas sobre Contratos de compraventa internacional de mercaderías, la aplicación de la cual se excluye expresamente. En la medida de lo permitido por la ley aplicable, el Cliente y AT&T acuerdan que cualquier causa de acción que surja de o en relación con esta Licencia, la Aplicación o el uso que el Cliente haga de la Aplicación debe iniciarse antes de que transcurra un (1) año de surgida la causa de la demanda y según la cláusula de resolución de disputas del CSA. De lo contrario, dicha causa de acción prescribirá para siempre. Esta Sección 11.1 no tiene la intención de modificar y no modifica ninguna de las disposiciones del CSA.

11.3 Divisibilidad.

Si cualquiera de las disposiciones de esta Licencia fuera considerada inválida o carente de fuerza ejecutoria, el resto de las disposiciones no se verán afectadas y seguirán vigentes y ejecutables en la máxima medida permitida por la ley.

11.4 Exención.

Excepto lo estipulado en la presente, el hecho de que no se ejerza alguno de los derechos o no se exija el cumplimiento de alguna de las obligaciones adquiridas en virtud de esta Licencia no afectará la capacidad de las partes de ejercer tal derecho o exigir el cumplimiento de tal obligación en cualquier momento posterior y la exención de un incumplimiento no constituirá una exención de cualquier otro incumplimiento posterior.

11.5 Control de exportaciones; uso legal.

Tú y las personas de tu familia no podrán exportar ni reexportar la aplicación, excepto según lo autorizado por la legislación de los Estados Unidos y las leyes de las jurisdicciones en las que se obtuvo la aplicación. Declaras y garantizas que tú y tu familia no están ubicados ni usarán la aplicación en ningún país que (a) esté sujeto a un embargo del Gobierno de USA, o que haya sido designado por el Gobierno de USA como un país "que apoya a los terroristas", o (b) esté incluido en la lista del Gobierno de USA de partes prohibidas o restringidas, incluidas la Lista de Ciudadanos Especialmente Designados del Departamento del Tesoro o la Lista de Personas o Entidades Rechazadas del Departamento de Comercio de USA. Tú y tu familia no pueden usar la aplicación de ninguna manera o con ningún fin prohibidos (a) por la legislación de los Estados Unidos, sin importar dónde tú y tu familia usen la aplicación, o (b) por la legislación local, en la jurisdicción donde tú y tu familia usen la aplicación.

11.6 Pruebas de rendimiento o evaluación comparativa.

Tú y las personas de tu familia no pueden divulgar los resultados de ninguna prueba de evaluación comparativa que utilice la aplicación a ningún tercero sin el previo consentimiento por escrito de AT&T.

11.7 Enmiendas o modificaciones.

To the extent not prohibited by law, AT&T may modify or amend the terms of this License at any time, with or without direct notice to You, by posting a copy of the modified or amended License available through the App or at https://www.att.com/legal/terms.securefamilyeula.html. Se considerará que tú y las personas de tu familia han aceptado tal modificación o enmienda si continúan usando la aplicación con posterioridad a la fecha en que la licencia modificada o enmendada se puso a disposición a través de la aplicación o en el sitio web antes mencionado.

11.8 Vigencia.

Todas las disposiciones de esta Licencia que, por su lenguaje explícito o contexto, indiquen que siguen estando vigentes aunque se cancele esta Licencia seguirán estando vigentes a pesar de dicha cancelación.

11.9 Terceros beneficiarios.

Salvo que se indique de manera explícita en esta Licencia o en los acuerdos relacionados, ninguna de las secciones de esta Licencia pretende otorgarle a ninguna persona (que no sea una de las partes aquí mencionadas) ningún derecho, beneficio o recurso de ningún tipo o carácter, ni crear obligación o responsabilidad alguna de una de las partes ante esa persona.

11.10 No transferencia.

Todo intento de transferencia por parte del Cliente en quebrantamiento de esta Licencia se considerará nulo. Estas obligaciones siguen estando vigentes aunque se cancele esta Licencia. AT&T puede transferir esta Licencia sin restricciones.

11.11 Notificaciones de los Derechos de autor según la DMCA

Usted puede enviar a AT&T una notificación válida de reclamaciones sobre violaciones a los derechos de autor según la Ley de Derechos de Autor para Medios Digitales del Nuevo Milenio ("DMCA", por sus siglas en inglés) El agente designado de AT&T para recibir notificaciones de supuestos incumplimientos según se describe en DMCA subsección 512(c)(3) es:

11.12 Acuerdo completo.

Esta Licencia y los documentos que aquí se incorporan por referencia constituyen el pleno acuerdo entre las partes con respecto al uso de la Aplicación, y sustituyen todos los acuerdos anteriores y actuales al respecto.

12. Términos de la licencia de código abierto.

La Aplicación puede usar el siguiente Software de código abierto que tiene la licencia de Apache versión 2.0; el Cliente no podrá usar este archivo salvo de conformidad con la Licencia. El Cliente puede obtener una copia de la Licencia en https://www.apache.org/licenses/LICENSE-2.0.

A menos que lo exija la ley aplicable o se acuerde por escrito, el software que se distribuye conforme a esta Licencia se distribuye "TAL COMO ESTÁ", SIN GARANTÍAS NI CONDICIONES DE NINGÚN TIPO, ya sean expresas o implícitas.
